Modise appoints panel to assess Mkhwebane’s fitness to hold office

National Assembly Speaker, Thandi Modise has appointed a panel to assess Public Protector, Busisiwe Mkhwebane’s fitness to hold office.

The panel includes retired Constitutional Court Judge Bess Nkabinde, senior counsel Dumisa Ntsebeza, and Johan de Waal.

The motion to remove Mkhwebane from her role as public protector was tabled by DA chief whip, Natasha Mazzone earlier this year.

There has been mounting calls for the removal of the Public Protector after the Constitutional Court found that she acted in bad faith when she investigated the South African Reserve Bank’s bailout of Bankorp.

The Public Protector is currently fighting separate court cases with President Cyril Ramaphosa and Public Enterprises Minister Pravin Gordhan.

But Mkhwebane is challenging her removal in court.

The first part of her case was dismissed by the Western Cape High Court last month.

The court heard her application for leave to appeal the decision earlier this week before it reserved judgment.
